Full judgment

1. This appeal is struck out, pursuant to Rule 8(3)(a) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (‘the Rules’) as having no reasonable prospects of success, as the Appellant, on 1 May 2025, failed his maximum third attempt at passing the Part 3 test to become a qualified Approved Driving Instructor.

2. Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 provides that a trainee licence remains in force until the day immediately following a trainee’s third unsuccessful attempt to pass the said Part 3 test.

3. On 2 May 2025, the Respondent made application to have this appeal struck out in the said circumstances. I grant the Respondent’s application in all the circumstances without further direction.

4. I have considered the matter and have had regard to the overriding objective that requires the Tribunal to deal with appeals fairly and justly.
