1. In order to qualify as an Approved Driving Instructor, applicants must pass the Qualifying Examination. This comprises: the written examination (‘Part 1’); the driving ability and fitness test (‘Part 2’); and the instructional ability and fitness test (‘Part 3’).
2. Three attempts are permitted at each part. The whole examination must be completed within 2 years of passing Part 1 (unless the Part 3 test has been booked before the expiry of 2 years) failing which the whole examination has to be retaken.
3. The Appellant failed his third and final attempt at the Part 3 instructional ability test on 23 October 2025.
4. By directions from the Registrar dated 24 October 2025, the Appellant was given the opportunity to make representations on why the appeal should not be struck as having no reasonable prospects of success within 21 days. He did not provide any representations.
5. A further opportunity to provide representations by 1 December 2025 was given by directions from a legal officer dated 17 November 2025. No representations were provided.
6. As the Appellant has failed his third attempt, I find that the appeal has no reasonable prospects of success.
7. In the circumstances I am satisfied that is in the interests of justice and in accordance with the overriding objective to strike out the appeal under rule 8(3)(c) of the Rules. Signed Date: Sophie Buckley 2 December 2025
